Merlin, Hunter & Associates is a missing person agency dedicated to assisting clients in locating missing individuals. Our Services may include, but are not limited to:

* Providing updates and reports to clients on the progress of investigations.

 

The specific scope and nature of the Services provided will be determined on a case-by-case basis and outlined in a separate agreement or engagement letter between you and Merlin, Hunter & Associates.

 

3. User Obligations

By using our Site or Services, you agree to:
* Provide accurate, complete, and truthful information to us in connection with your inquiries and cases.
* Cooperate fully with our investigations and provide us with all relevant information and access as reasonably requested.
* Comply with all applicable laws and regulations in your use of our Site and Services.

* Be responsible for maintaining the confidentiality of any login credentials or account information provided to you.

4. Fees and Payment

Fees for our Services will be determined based on the specific nature and complexity of each case and will be outlined in a separate agreement or engagement letter. You agree to pay all fees and expenses as agreed upon in the engagement letter. Payment terms will also be specified in the engagement letter. We may require an initial retainer fee before commencing Services.

 

5. Confidentiality

We understand the sensitive nature of missing person cases and are committed to maintaining the confidentiality of the information you provide to us. We will take reasonable
measures to protect your confidential information in accordance with our Privacy Policy and any specific confidentiality agreements we may enter into with you. However, we may be
required to disclose information as required by law or legal process.

 

6. Intellectual Property

The content, design, graphics, and other materials on our Site are owned by or licensed to Merlin, Hunter & Associates and are protected by copyright, trademark, and other intellectual
property laws. You may not reproduce, modify, distribute, or otherwise use any content from our Site without our prior written consent.

THE OUTCOME OF A MISSING PERSON CASE CAN BE INFLUENCED BY NUMEROUS FACTORS BEYOND OUR CONTROL.

 

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MERLIN, HUNTER & ASSOCIATES AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR USE OF OUR SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT OF FEES YOU HAVE PAID TO US FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.

You agree to indemnify, defend, and hold harmless Merlin, Hunter & Associates and its affiliates, officers, directors, employees, agents, and licensors from and against any and all
claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms, your use of our Site or Services, or your violation of any law or the rights of a third party.

 

10. Termination

We reserve the right to suspend or terminate your access to our Site or Services at any time, with or without cause and without notice. You may also terminate your engagement of our
Services upon written notice, subject to the terms outlined in your engagement letter. Upon termination, any outstanding fees and expenses shall become immediately due and payable.

 

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

 

12. Entire Agreement

These Terms, together with our Privacy Policy and any separate engagement letter or agreement you enter into with us, constitute the entire agreement between you and Merlin, Hunter & Associates with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether oral or written.

 

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

 

14. Waiver

Your failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
